Terms of Service
Thank you for signing up with Property Line, the online database that allows Real Estate Professionals to market their properties by providing detailed listing information to the commercial real estate brokerage community via the Property Line website. Agents then query the listing database via the Property Line Desktop to receive detailed listing and broker contact information that meets their search requirements. The Property Line Listing Express feature provides updates of new listings that meet the search parameters but have been entered into the Property Line database after the search has been completed.
The following are the terms and conditions for the submission of information to, and use of, the PropertyLine.com ("Property Line") website service (the "Service"). Please read them carefully. BY CHECKING THE "I ACCEPT" BOX AND COMPLETING THE REGISTRATION PROCESS, YOU ARE STATING THAT YOU AGREE TO AND ARE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE PROPERTY LINE TERMS OF SERVICE BELOW.

SUBSCRIPTION PRODUCT ORDERING
Some of the products offered are on a subscription basis. By ordering these products, you are authorizing Property Line to charge your account each month. Cancellations can be requested by emailing billing@propertyline.com or calling the Billing Department at 702.889.1063. Cancellations are not complete until you receive your Confirmation Number from the Billing Department. Please keep this number for future reference.

MEMBER SUBSCRIPTION FEES (NEVADA)
Member subscription fees are $40.00 or $55.00 paid monthly with Property Line's AutoPay system. Your credit card will be debited on or about the same day each month as the day you register. Cancellations can be requested by emailing billing@propertyline.com or calling the Billing Department at 888.889.1063. Cancellations are not complete until you receive your Confirmation Number from the Billing Department. Please keep this number for future reference.
SUBMISSION AND MAINTENANCE OF LISTINGS
Customer shall not submit any property descriptions, photographs, financial, contact or other information ("Listings") to the Property Line site unless (i) Customer has received all necessary rights and authorizations, including, but not limited to, the owner of the property listed, any necessary representing agents or brokers, the author of the Listing, including the photographer and/or copyright owner of any photographs, as applicable, to publish and advertise the Listing as part of the Service and allow the Listing to be accessed, downloaded and/or copied by users of the Service; and (ii) the Listing is accurate and Customer agrees to administer the Listing and maintain its accuracy at all times. Customer represents, warrants and covenants that the foregoing is correct at the time of submission and will remain correct as long as the Listing is used in connection with the Service.
Customer agrees to post a listing only once as Property Line may delete multiple entries of the same property. Customer understands that Property Line is intended for the listing of commercial property only and residential listings may be deleted without prior notice.
DISCLAIMER OF WARRANTIES
Property Line does not represent or warrant that the Service and all information, text, graphics, images, hyperlinks and other material available on or through the service (the "Materials") will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available, are free of viruses or other harmful components. Property Line does not warrant or represent that the use or the results of the use of the materials available through the Service or from third parties will be correct, accurate, timely, reliable or otherwise. Listings provided by Property Line should be used solely to obtain information from which further evaluation and investigation may commence. Property Line's service includes links to content from third parties. Property Line does not control in any respect any information, products or services offered by these third parties. The materials available through Property Line and any third party are provided "as is" and "as available" and without warranties or conditions of any kind either expressed or implied. To the fullest extent permitted by applicable laws, Property Line expressly disclaims all warranties and conditions, expressed or implied, including, but not limited to, implied warranties and conditions of merchantability, merchantable quality, correspondence to description and fitness for a particular purpose.
Please Note: Property Line cannot be held responsible for outside Internet and email providers' (including, but not limited to: AOL, Earthlink, Yahoo, Hotmail, etc.) filtering policies.

LIMITATION OF LIABILITY
To the fullest extent permitted by applicable laws, under no circumstances, including, but not limited to, negligence, shall Property Line be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or the inability to use the Service, any changes to the Service, unauthorized access to or alteration of your transmissions or data, any material or data sent or received or not sent or received, or any transactions entered into through the Service. You specifically agree that Property Line is not responsible or liable for any illegal content or conduct of any other party or any infringement of another's rights, including intellectual property rights. If you are dissatisfied with the Service, the Materials available on or through the Service, or with any of Property Line's terms and conditions, your sole and exclusive remedy is to contact the Property Line office in writing to request the cancellation of your account. Written notice can be submitted via standard mail, e-mail or fax. LIMITATION OR EXCLUSION OF WARRANTIES CONDITIONS, AND/OR LIABILITY FOR SOME TYPES OF DAMAGES MAY NOT BE PERMITTED IN SOME JURISDICTIONS, IN WHICH CASE SOME OR ALL OF THE ABOVE SECTIONS MAY NOT APPLY TO YOU. IF PERMITTED BY LAW, PROPERTY LINE'S LIABILITY IS LIMITED TO RESUPPLYING THE SERVICE.
INDEMNIFICATION
You agree to indemnify and hold Property Line and its officers and employees, harmless from any claim, demand, or damage, including reasonable attorney's fees, asserted by any third party due to or arising out of your use of or conduct on the Service.
TERMINATION
Property Line may terminate the Service with or without cause at any time and effective immediately. In addition, Property Line, in its sole discretion, may terminate your account for violation of the letter or spirit of the Terms of Service. Cancellations can be requested by emailing billing@propertyline.com or calling the Billing Department at 702.889.1063. Cancellations are not complete until you receive your Confirmation Number from the Billing Department. Please keep this number for future reference. Property Line shall have no obligation to maintain any content in your account or to forward any unread or unsent messages to you or any third party. Property Line has the right but not the obligation to remove any user postings in its sole discretion.
PROPRIETARY RIGHTS TO CONTENT
You acknowledge that content, including but not limited to text, software, music, sound, photographs, video, graphics or other material containing information presented to you by Property Line or Property Line's Advertisers or other content providers, is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. You may make a copy of this content for your personal non-commercial use only, provided that you keep all copyright and other proprietary notices intact. You may not modify, copy, reproduce, display, perform, republish, upload, post, transmit, or distribute in any way content available through the Service, including code and software, except as authorized under the Terms of Service.
MODIFICATIONS TO TERMS OF SERVICE, MEMBER POLICIES
Property Line reserves the right to change the Terms of Service or policies regarding the use of the Service at any time and to notify you by posting an updated version of the Terms of Service on the Property Line site.
MEMBER ACCOUNT, PASSWORD, AND SECURITY
To open a Property Line account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the Registration Form. You then will choose a password and an account name. Your password is for your individual use. It is a violation of the Terms of Service to share a password with other agents or to allow other agents to enter the listings they have taken under your password. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Property Line immediately of any unauthorized use of your account or any other breach of security.
OTHER RIGHTS OF PROPERTY LINE
You agree that Property Line shall have the right to use Listings and other information submitted to the service for any purpose, without compensation of any kind to you, including but not limited to publication of all or part of such Listing on the world wide web for unrestricted use by customers. Property Line shall have sole authority to choose the manner in which any Listing will be received, displayed and used by the Service, and reserves the right to remove all or any part of a Listing or refuse Services to anyone at any time in its sole discretion. Property Line shall have no obligation to (i) resolve disputes among users of the Service; or (ii) monitor or verify the accuracy or proper use of the Listings.
USER CONDUCT
Any unauthorized commercial use of the Service, or the resale of its services, is expressly prohibited. You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your account or password, including the content of your transmissions through the Service. By way of example, and not as a limitation, you agree not to: A. attempt to gain unauthorized access to the Service, other accounts, computer systems or networks connected to the Service, through password mining or any other means; or B. interfere with another member's use and accessibility of the Service or another entity's use and accessibility of similar services. C. use the client directory to mass email other members of Property Line.
LAWS
The Terms of Service shall be governed by and construed in accordance with applicable state law and the laws of the United States of America, excluding their conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in the state of Nevada. If any provision(s) of the Terms of Service is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of Property Line with the other provisions remaining in full force and effect. Property Line's failure to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Property Line in writing. You agree that any cause of action arising out of or related to this Service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred.
PRODUCT DISPUTE AND RESOLUTION POLICY
The Property Line member initiating the order is responsible for the accuracy of the information contained therein, in both Custom and iDesign eMarket orders. Clients are advised to confirm their orders by reviewing all stages of the ordering process or by reviewing the Custom eMarket Proof sent to the email address indicated on the order. Client assumes responsibility for errors contained within an eMarket; said client approves all proofing before sending.
Due to the highly automated processes incorporated in the fulfilling of an order, any changes required after creation must be communicated to Property Line by email to Customer Service at info@propertyline.com or via phone 888.889.1063 during normal business hours, Monday - Friday (excluding holidays), 8:00 AM - 5:00 PM Pacific Time, as soon as possible. Property Line cannot accept voice mail requests to change or cancel an order. Any changes to an order can result in delays in the queuing of your order. Changes can only be made prior to distribution. Any required changes after the eMarket has been distributed may require a new order which will incur additional fees.
Orders can only be canceled by direct telephone call to the Customer Service Department during normal business hours (Monday - Friday 8:00 - 5pm Pacific Time, excluding holidays). Cancellation requests must be made directly with a Customer Service Representative. Property Line does not accept voice mail requests to cancel an order. Orders may be canceled up until the order has been queued for send on that day. Orders that have been queued for that day will be billed as completed. Credit or debit cards used as payment on orders are authorized for the original order amount upon receipt of the order. Payment must be made prior to processing any eMarket. Payment authorizations instituted on canceled orders will remain active in accordance with the credit or lending institutions policies. Property Line is not liable for such authorization periods.
Please Note: eMarkets containing links, products, or content that explicitly belong to an outside listing vendor are prohibited. Property Line cannot vouch for the accuracy of the information contained therein. Furthermore, Property Line cannot attest to the safety or quality of the programming used.
CREDIT POLICIES
Should you feel an eMarket was not completed as requested, Property Line offers two types of resolutions:
REPLACEMENT EMARKET
If Property Line introduces an error, Property Line will resend the eMarket at no charge. This does not cover customer initiated errors such as, but not limited to:
- Incorrect art, low-resolution photography, or errors in text/copy.
- Failure to check Custom eMarket proofs or iDesigns carefully.
Replacements on Custom eMarkets will be charged an additional creation fee. Contact Property Line Customer Care at 888.889.1063.
CREDIT FOR FUTURE EMARKET
If Property Line introduces an error, we can put a credit into your account for use on a future eMarket. This does not cover customer initiated errors such as, but not limited to:
- Incorrect art, low-resolution photography, or errors in text/copy.
- Failure to check Custom eMarket proofs or iDesigns carefully.
- Failure to enter a promo or offer code at time of applicable order.
Purchase Power accounts are non-refundable. However, they can be transferred to another broker with authorization by the primary account holder via an email to billing@propertyline.com.
Contact Property Line Customer Care at 888.889.1063. Credits on Custom eMarkets will not include the creation fee.
RECURRING BILLING POLICY
Please Note: Some products are billed on a recurring basis. These products will be billed monthly until client contacts Property Line's Billing Department directly and asks to cancel. Cancellations can be requested by emailing billing@propertyline.com or calling the Billing Department at 888.889.1063. Cancellations are not complete until you receive your Confirmation Number from the Billing Department. Please keep this number for future reference.
Property Line cannot refund recurring billing products as the service has already been rendered.
Before placing an order, or using any of the Property Line products and services, you will need to agree to the Property Line Privacy Policy and other terms and conditions detailed in the Terms of Service document.
